DECISION
On the establishment of Thai Binh provincial Economic zone and Industrial park Management Board
PRIME MINISTER
Pursuant to the Law on Organization of the Government dated 19 June 2015;
Pursuant to the Law on Organization of Local Authorities dated 19 June 2015;
Pursuant to the Government's Decree No. 118/2015 / ND-CP of November 12, 2015 detailing and guiding the implementation of a number of articles of the Investment Law;
Pursuant to the Government's Decree No. 29/2008 / ND-CP of March 14, 2008, on industrial parks, export processing zones and economic zones, and Decree No. 164/2013 / ND-CP of November 12, 2008, 2013, amending and supplementing a number of articles of Decree No. 29/2008 / ND-CP;
At the proposal of the president of the People's Committee of Thai Binh province in Report No. 162 / TTr-UBND of September 27, 2017 and the Minister of Home Affairs in Document No. 5440 / BNV-TCBC dated 11 October 2017,
HEREBY DECIDES:
Article 1. Establish and define the position and functions of the Management Board of economic zones and industrial zones of Thai Binh province
1. To set up the Management Board of Thai Binh Economic Zones and Industrial Zones (hereinafter referred to as the Management Board) on the basis of reorganizing the Management Board of Industrial Parks of Thai Binh Province.
2. The Management Board is an agency attached to the People's Committee of Thai Binh province, performing the function of state management over economic zones and industrial parks in Thai Binh province; Organizing the provision of public administrative services and other support services related to investment and production and business activities for investors in economic zones and industrial parks in the province according to regulations of laws.
3. The Management Board has the legal status, its own account, the seal of national emblem; State administrative management expenditures, non-business operation funds and development investment capital shall be allocated from the state budget according to annual plans and other funding sources as provided for by law.
Article 2. Tasks and powers of the Management Board
The Management Board shall perform the tasks and exercise the powers defined in:
1. The Government's Decree No. 118/2015 / ND-CP of November 12, 2015 detailing and guiding the implementation of a number of articles of the Investment Law.
Article 37 and Article 38 of the Government's Decree No. 29/2008 / ND-CP of March 14, 2008, on industrial parks, export processing zones and economic zones, and Clause 21, Article 1 of the Government's Decree No. 164 / 2013 / ND-CP dated November 12, 2013 of the Government amending and supplementing a number of articles of Decree No. 29/2008 / ND-CP.
3. Other relevant legal documents.
Article 3. Organizational structure and payroll of the Management Board
1. Leader of Management Board:
The Management Board is chaired by a chairperson and no more than 3 deputy heads.
The head, deputy heads shall be appointed by the president of the People's Committee of Thai Binh province; The mobilization, rotation, commendation, punishment, dismissal, resignation, retirement and implementation of other policies and regimes for heads and deputy heads shall be decided by the president of the People's Committee of Thai Binh province in accordance with the law.
2. The Management Board includes: Its office and 03 professional divisions; Public service units.
3. Payroll: The payroll of civil servants and the number of officials of the Management Board shall be included in the total payroll of civil servants and the number of officials of the People's Committee of Thai Binh province
Article 4. Valid time of the decision
This decision takes effect from the date of its signing. To annul the previous regulations which are contrary to this decision.
Article 5. Responsibility for implementation
The ministers, the heads of the ministerial-level agencies, the heads of the agencies attached to the Government, the president of the People's Committee of Thai Binh province, the head of the Management Board of Thai Binh economic zones and industrial parks shall have to implement this decision./.
